I thought the relevant section in the Public Order Act dealing with speech likely to 'offend' had been rescinded by the Home Secretary, Theresa May?

I'm not saying it didn't happen but I'm questioning its legality. I think Tony should sue for wrongful arrest. If the police had to pay out every time they did this kind of thing then they may have second thoughts.
DeleteA minister cannot "rescind" part of an Act of Parliament. That requires another Act.
DeleteIt is not wrongful arrest if police decide not to proceed with a prosecution.
The issue is whether the arresting officer felt that there was reasonable grounds for believing that the Public Order Act had been breached. From what is said in the video it appears that there may not have been sufficient evidence to justify an arrest.

Delete'The Government gave way tonight, and agreed to reform Section 5 of the Public Order Act to give more protection to free speech.
Today, in the House of Commons, Home Secretary Theresa May said the word ‘insulting’ would be removed from Section 5 of the Public Order Act, as part of the Crime and Courts Bill.
The amendment to the law was put forward by Lord Dear, a former HM Inspector of Constabulary, and when discussed in the House of Lords, peers voted by 150 to 54 in favour of the change.
The Government today announced that it would not overturn the amendment but will allow it to become law.'
You may or may not be right about the issue of unlawful arrest being only applicable to prosecution but an overnight stay in police cells seems to me like an arrest. It's worth an investigation.
Further to my earlier post; this is from the Telegraph, 11th May 2013; 'A leading criminal defence lawyer has won more than half a million pounds from police after being wrongly arrested and held in cells for 30 hours.'

'Mr Watson, a father-of-two from Teeside, told how he was locked in a cell for 30 hours and his home and offices were searched by police.
DESPITE NEVER BEING CHARGED [emphasis mine], he spent more than 10 months on bail with the allegations always denying any wrongdoing.'[sic]
I think unlawful arrest means just that and that Tony should make a legitimate complaint. I also think he should have made a complaint against the woman who told him to 'F' off. It's only when these people [including the police] get a taste of their own medicine that they will learn that you can't use the law to restrict people from expressing their views.

ReplyDeleteWow, may the Lord give each of us the grace to be strong in these times. We need to pray for one another, even Paul the Apostle asked for prayer that he would be bold as he ought. None of us are above faltering at times, we need to encourage each other and build each other up. Never before has there been a time that the true body of Christ needs each other so much as today, with rampant apostasy inside, and persecution outside. They will know we are Christians by our love for one another.
